Terms of Service

Agreeing to these Terms

These Terms of Service (“Terms”) are an agreement between you and [COMPANY LEGAL NAME] (“Vantage”, “we”, “us”). They cover your use of the Vantage mobile app and the services that support it (together, the “Service”).

You accept these Terms when you create an account or use the Service. If you don’t agree, don’t use the Service. Our Privacy Policy explains how we handle personal information. It forms part of these Terms.

Who can use Vantage

You must be at least 18 years old, and able to enter a binding contract, to create an account or use the Service. If you are under 18, don’t use Vantage. If we learn that an account belongs to someone under 18, we may delete it.

You may not use the Service if the law where you live prohibits it, or if we have previously terminated your account for breaking these Terms.

What Vantage is

Vantage is a personal dashboard for your own use. It lets you log and review:

  • Health: meals and foods, water, caffeine, supplements and, on iPhone, sleep, steps, resting heart rate and heart rate variability from Apple Health;
  • Training: workouts, workout templates, sets and weights, weigh-ins and body measurements;
  • Money: accounts, balances and transactions that you enter by hand;
  • Daily priorities, tasks and notes.

From what you log, Vantage calculates a Day Score from 0 to 100, suggests daily targets, and can show a short AI-written summary of your day.

Vantage is for personal, non-commercial use. It is not a medical, nutrition, fitness-coaching or financial service, and no professional relationship is created by using it. Some parts of the Service are still in development. Some screens may show sample data, and these screens are labeled.

Your account

You need an account to use the Service. You can sign in with Apple, with Google, or with an email address and password. We confirm email addresses with a one-time code. Accounts are provided through our authentication provider, Clerk.

When you set up your account, we ask for your name, birthday, gender, height, weight, activity level, goals and the areas you want to track. Please keep this information accurate. Vantage uses it to calculate your targets and your Day Score.

You are responsible for:

  • keeping your sign-in details secure and not sharing your account;
  • everything that happens under your account, unless it results from our failure to take reasonable security measures;
  • telling us promptly at [CONTACT EMAIL] if you think someone else has accessed your account.

Each account is for one person.

Health information is not medical advice

Vantage does not provide medical advice, diagnosis or treatment, and is not a medical device. Don’t use it in place of advice from a doctor, dietitian or other qualified professional. In an emergency, contact your local emergency services.

The targets Vantage suggests come from general formulas applied to your profile. They are not personalized advice. For example, calorie targets use a standard resting-energy estimate adjusted for your activity level and goals. Water, protein, caffeine, sleep and step targets also use general rules of thumb. You can change any of them in Profile.

The Day Score and its summary describe the data you have logged or connected. They don’t measure your health. Supplement amounts shown when you add a supplement are common label amounts, so you don’t have to fill in the form yourself. They are not recommendations. Always follow the label of the product you take.

Talk to a qualified professional before you change your diet, exercise or supplements. This is especially important if you are pregnant or breastfeeding, have a medical condition, take medication, or have a history of disordered eating.

Money features are not financial advice

The Money section is a record you keep by hand. Vantage doesn’t connect to your bank or any financial institution. It doesn’t move money, and it doesn’t check that your figures are correct. Amounts are shown in US dollars.

Net worth, spending totals and savings progress are calculated only from what you enter. Vantage gives no investment, tax, legal or financial advice, and you shouldn’t rely on it as a financial record.

Food and nutrition data

Nutrition values in Vantage come from third-party food databases: the fatsecret Platform API, USDA FoodData Central, and Open Food Facts (made available under the Open Database License). They also come from foods you create yourself. The source is shown where the data appears.

These databases can be incomplete, out of date or wrong, and barcodes may not match the product you have. We don’t guarantee the accuracy of any nutrition value. You can correct a food’s values. A correction applies only to your own account.

You may use food data only through the app for your personal tracking. Don’t copy, scrape or bulk-extract it.

AI features

Some features use generative AI provided by Google (the Gemini API):

  • Describe a meal: you type what you ate, and AI lists the foods and amounts.
  • Voice log: you record what you ate, and AI transcribes it and lists the foods and amounts.
  • Meal scan: you photograph a meal, optionally with a note, and AI identifies the foods and estimates portion sizes.
  • Daily verdict: AI writes a short summary of your Day Score and suggests a next step.

How AI output is used

For meals, AI only names foods and estimates amounts. Vantage then looks up the nutrition values in the food databases described in section 7. For the daily verdict, AI explains the score but never sets or changes it. The score is calculated from your data.

AI output can be wrong. It may misidentify foods, misjudge portions, mishear speech or misdescribe your day. Results from describe, voice and scan are drafts. Nothing from them is saved to your food diary until you review and confirm it. You are responsible for what you save.

What is sent to the AI provider

When you use an AI feature, we send Google the content needed for that request:

  • for describe, your text;
  • for voice, your recording;
  • for scan, your photo and note;
  • for the verdict, a summary of today’s score, which can include values such as sleep, steps and resting heart rate, your calorie, protein and water totals and targets, and your open priorities for the day.

We currently use Google’s unpaid Gemini API service. Under Google’s terms for that service, Google may use the content sent to it, and the responses it returns, to provide, improve and develop its products and machine-learning technologies. Don’t include anything in a note, photo or recording that you don’t want shared this way, such as other people’s faces, documents or identifying details. The Privacy Policy has more detail.

Daily limits

To keep the Service available to everyone, AI features have daily limits per account. These are the current limits:

When you reach a limit, you can still log food by searching or scanning a barcode. We may change these limits. AI features may also be unavailable when the AI provider is down or limits our access.

Apple Health

On iPhone, you can connect Apple Health. Vantage asks for access only after you tap Connect. It reads sleep, including Apple Watch sleep stages where available, steps, resting heart rate and heart rate variability. Vantage only reads from Apple Health. It never writes to it.

You control this access in the iPhone Settings app under Health. If you remove access, Vantage stops reading new data and the Day Score treats those inputs as missing. Apple Health is provided by Apple, under Apple’s terms.

Your content

“Your content” means everything you put into Vantage. That includes your profile answers, meals and food logs, custom foods, recipes, saved meals, corrections, meal photos and notes, voice recordings, workouts, measurements, money entries, tasks and notes.

You own your content. You give us a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process and display your content only as needed to provide the Service to you. This includes sending it to the service providers described in section 8 and section 13 to carry out the features you use. The licence ends when your content is deleted, except as described in section 17.

Vantage has no feature that shows your content to other users. Custom foods, recipes, saved meals and corrections are visible only in your own account.

Meal photos and recordings

Meal-scan photos are stored privately, in a folder for your account. They open only through links that expire after 10 minutes. If you discard a scan, its photo is deleted. Photos from scans you saved stay in your account until you delete your account, even if you later delete the meal. Voice recordings are sent for transcription and are not stored in your Vantage account.

Your responsibilities

You confirm that you have the right to upload your content, and that it doesn’t break the law or anyone else’s rights.

Feedback

If you send us suggestions or feedback, we may use them without any obligation to you.

Where your data is kept

Vantage currently keeps your data in two places, and the difference matters.

With your account, on our servers: your profile, targets and settings, meals logged through food search, barcode, describe, voice or scan, your custom foods, recipes, saved meals, favorites and corrections, meal-scan photos, daily verdicts, and counts of your AI usage.

Only on your device: drinks, water and caffeine, supplements, tasks and notes, priority check-offs, weigh-ins and body measurements, workouts and templates, money accounts, transactions and balances, and your past Day Scores and day history.

We don’t receive or back up device-only data. If you lose or reset your device, delete the app, or sign in on another device, that data won’t be there, and we can’t recover it.

Acceptable use

When you use the Service, you agree not to:

  • access or try to access another person’s account or data;
  • get around, or try to get around, the AI daily limits, rate limits or any security or access control;
  • use bots, scripts or other automated means to access the Service, or call its servers other than through the app;
  • copy, scrape or bulk-extract food data, or use the Service to build a competing database or product;
  • upload content that is unlawful or infringing, or images of other people taken or shared without their consent;
  • upload malware, or interfere with or overload the Service or the providers it relies on;
  • reverse engineer, decompile or disassemble the app, except where the law allows this despite this restriction;
  • resell, sublicense or otherwise use the Service commercially;
  • use the Service in a way that breaks the law or these Terms.

Third-party services

The Service relies on the following third parties. Where you use one of their services directly, such as signing in with Apple or Google or connecting Apple Health, their own terms and privacy policies apply to that use.

  • Clerk: accounts and sign-in.
  • Apple and Google: sign in with Apple and sign in with Google.
  • Google (Gemini API): AI features (see section 8).
  • fatsecret, USDA FoodData Central and Open Food Facts: food and nutrition data.
  • Apple Health: health data you choose to share, on iPhone.
  • Neon: database hosting.
  • ImageKit: private storage of meal-scan photos.
  • Trigger.dev: background processing of meal scans and account updates.
  • Sentry: error, crash and performance monitoring, which can include recordings of app screens.

We don’t control these services and aren’t responsible for them. If one of them changes, becomes unavailable or stops working with Vantage, the related features may change or stop working.

Fees

The Service is currently free. It has no paid plans and no in-app purchases. If we introduce paid features, we will tell you before they apply, and we won’t charge you unless you choose to buy them under the terms shown at that time.

Our intellectual property

The Service, including the app, its software, design, text and graphics, the Day Score, and the Vantage name and logo, belongs to us or our licensors and is protected by law. Your content is not part of this.

While you follow these Terms, we give you a personal, revocable, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own personal use. We keep all other rights. Some parts of the app are open-source software, provided under their own licences.

Changes to Vantage

Vantage is actively being developed. We may add, change or remove features, change daily limits, or change the third parties we rely on. If a change takes away a feature you use in a significant way, we will try to tell you in advance. We don’t promise that the Service, or any feature, will always be available or free of errors.

Deleting your account, suspension and termination

Deleting your account

You can stop using Vantage at any time. To delete your account, open Profile, tap Delete your account and confirm. This permanently deletes:

  • your meal-scan photos;
  • all of the data stored with your account on our servers (see section 11);
  • your sign-in account, which also signs you out everywhere.

It also clears your device-only data from the device you used to delete the account. If you used Vantage on other devices, delete the app on each of them to remove that data. Deletion can’t be undone. If deletion fails partway, the app tells you, and trying again finishes the job.

Copies of some information may remain for a limited time in our service providers’ logs and backups, and in records we must keep by law. These include a record that your account was deleted, and diagnostic logs that may mention foods identified in a meal scan. They are deleted on those providers’ normal schedules, [RETENTION PERIOD, e.g. within 30–90 days]. Content you sent to Google through AI features is handled under Google’s terms (see section 8).

Suspension and termination by us

We may suspend or terminate your access if:

  • you seriously or repeatedly break these Terms;
  • we must do so by law;
  • your use creates a security or legal risk for us or others;
  • we stop offering the Service.

Where reasonable, we will tell you first and give you a chance to fix the problem. If we stop offering the Service, we will give you at least [30] days’ notice.

Sections 5–8, 10 (feedback), 15 and 18–24 continue to apply after your account ends.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t warrant that the Service will be uninterrupted, secure or error-free, that nutrition data, AI output, targets or scores will be accurate or complete, or that data stored only on your device will be preserved.

Some jurisdictions don’t allow certain warranties to be excluded. In those places, these exclusions apply only as far as the law allows, and you keep any rights you have as a consumer that can’t be waived.

Limitation of liability

To the fullest extent permitted by law, we and our affiliates, officers, employees and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or health outcomes, arising from or related to the Service or these Terms, even if we were told such damages were possible.

Our total liability for all claims related to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose and (b) US$[100].

Nothing in these Terms limits liability that can’t be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Indemnity

To the extent permitted by law, you agree to defend and indemnify us against third-party claims, and the related losses and reasonable costs, arising from your content, your breach of these Terms, or your violation of the law or someone else’s rights. This section doesn’t apply where the law where you live doesn’t allow it.

Governing law and disputes

These Terms are governed by the laws of [STATE / COUNTRY], without regard to its conflict-of-laws rules.

If you have a dispute with us, please contact us first at [CONTACT EMAIL]. We’ll try to resolve it informally within 30 days. If we can’t, the dispute will be decided only by the courts located in [COUNTY / CITY, STATE / COUNTRY], and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in small-claims court if it qualifies.

If you are a consumer, you keep the protection of any mandatory laws of the country where you live, and you may be able to bring claims in your local courts.

App store terms

If you downloaded Vantage from Apple’s App Store

  • These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
  • Your licence to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for any claims by you or any third party relating to the app or your use of it. This includes product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
  • You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when you use the app, such as your mobile carrier’s terms.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

If you downloaded Vantage from Google Play

Google Play’s terms also apply to your download and use of the app. Google is not responsible for the app or these Terms.

Changes to these Terms

We may update these Terms as the Service changes or the law requires. We will post the new version here and update the “Last updated” date. If a change is material, we will tell you in the app or by email at least [14] days before it takes effect, unless the change is needed sooner for legal or security reasons. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don’t agree, stop using the Service and delete your account.

General

  • Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • Severability: if a court finds any part of these Terms unenforceable, the rest stays in effect.
  • No waiver: if we don’t enforce a right, we haven’t given it up.
  • Assignment: you may not transfer these Terms. We may transfer them as part of a merger, acquisition or sale of assets, and these Terms will continue to protect you.
  • Events outside our control: we aren’t responsible for delays or failures caused by events beyond our reasonable control, including outages at the third-party services listed in section 13.
  • Third-party beneficiaries: apart from Apple, as described in section 22, no one else has rights under these Terms.
